Terms of Service

1. Agreement

These terms govern your access to and use of Smoower (the "Service"), operated under the name Smoower ("we", "us"). By creating an account, installing our bot, or otherwise using the Service, you agree to these terms. If you are using the Service on behalf of an organisation, you confirm you are authorised to accept these terms for it.

2. What the Service is

Smoower publishes the Builder Mindshare Index — a benchmark of developer-focused companies and projects built from publicly available information — and a related product with private analytics, content tooling and community tracking. Scores and rankings are estimates produced by automated analysis; we provide them "as is" and do not guarantee they are complete, accurate or fit for any particular purpose.

3. Accounts

You are responsible for activity under your account and for keeping your sign-in secure. You must provide accurate information and not impersonate others or misrepresent your affiliation with an organisation. We may suspend or close accounts that breach these terms or are used unlawfully.

4. The public index

Entries in the public index are derived from public sources and concern organisations and projects, not individuals. If you are an authorised representative of a listed organisation, you can claim its entry to manage it, request corrections, or ask for it to be removed. We aim to handle reasonable requests promptly but may retain factual, publicly sourced information where we have a legitimate interest in doing so.

5. The Smoower Discord bot

If you add our bot to a Discord server, you confirm you have authority to do so and to authorise the collection described here and in our Privacy & Cookies policy. The bot produces community statistics from server activity. It does not store message content — only aggregate counts (members, growth, approximate message volume on channels you choose) and, once daily, sentiment scores with an AI-written paraphrase. You control which channels it can access and may remove the bot at any time to stop collection. You must comply with Discord's own terms and community guidelines when using the bot.

6. Acceptable use

You agree not to:

  • break the law or infringe others' rights when using the Service;
  • probe, scrape, overload, or attempt to gain unauthorised access to the Service or its data;
  • resell or redistribute the Service or its data except as expressly permitted;
  • misuse the bot to surveil individuals, or install it on servers you do not control.

7. Subscriptions & billing

Some features are paid. Paid plans — including supporter subscriptions and the Discord tracking add-on (€19.95 per month) — are billed in advance through our payment processor, Stripe, and renew automatically each period until cancelled. Prices are shown at checkout and may include applicable taxes.

You can cancel at any time from your billing settings; cancellation stops future renewals and access continues until the end of the current paid period. Except where required by law, payments are non-refundable. We may change prices or plan features with reasonable notice; changes take effect at your next renewal.

8. Intellectual property

The Service, including its software, design and the compiled index and scoring methodology, belongs to us and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these terms. Trademarks, logos and content belonging to third parties remain theirs.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that scores, analytics or sentiment estimates are accurate, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

12. Changes to these terms

We may update these terms as the Service evolves. Material changes will be reflected by the "last updated" date above and, where appropriate, an in-product notice. Continuing to use the Service after changes take effect means you accept the updated terms.
